Questions and answers

One skip after a renovation. Who must arrange waste separation?

Removing rubble alone does not settle a contractor's obligations. We explain private renovations, work by a business and contracting out waste sorting.

The skip leaves the site, but waste documentation may still be needed. When agreeing a renovation, discuss transport, arrangements for separation and subsequent treatment separately. These are different elements of the same service.

Does every site need six skips?

Rules in force since 2025 require arrangements to separate at least wood, metals, glass, plastics, gypsum and mineral waste including concrete and bricks. This may be entrusted to an authorised operator. The number of containers alone therefore does not establish compliance. WIOŚ in Gdańsk

What changes when a renovation company is involved?

As a rule, the Act identifies the service provider as the producer of waste arising from renovation services, unless the contract provides otherwise. It is not enough to assume all obligations belong to the flat owner. Journal of Laws / ELI

What if the owner renovates personally?

Where the producer is a natural person who is not an entrepreneur, the next holder receiving the waste performs the obligation under Article 101a(1). This differs from renovation carried out by a business. Journal of Laws / ELI

Does an invoice for the skip settle everything?

Entrusting the separation obligation requires a written contract, otherwise invalid, specifying further waste treatment. The Act also provides joint and several liability for the participants it identifies. An invoice for removal should not be confused with a complete arrangement. Article 101a additionally includes specific exceptions concerning technological feasibility of separation and recovery. Journal of Laws / ELI

What to agree before work starts

Our practical recommendation is to include waste in the discussion of job organisation. The contractor should know who orders collection, which materials may enter the container, who arranges the required separation and which documents will be supplied.

Ask the operator about the scope of its authorisations and how the waste will actually be treated. A general assurance that it takes everything does not answer these questions. Particular types of waste may require a separate procedure.

A clearly described offer also helps compare costs. A cheaper skip may include a different service, different permitted materials or surcharges initially overlooked by the customer. Discussing waste before demolition is usually easier than explaining discrepancies once the container is full.

Legislation considered as of 30 October 2026. The basis is Article 3(1)(32) and Article 101a of the Polish Waste Act.
